Terms of Service

1. Subject and Role of the Platform

1.1. This agreement governs the digital intermediary / booking service provided by the PLATFORM in relation to the tour agreed between the CLIENT and the licensed independent tour guide selected on OfficialGuides.com.

1.2. The PLATFORM acts solely as an intermediary: its function is to bring travelers and independent guides together through the platform, to provide communication (chat) tools, and to create and confirm the reservation. The tour itself is not provided, promised or guaranteed by the PLATFORM; performance of the tour is the sole responsibility of the relevant guide.

(“PLATFORM” or “OfficialGuides.com“)

CLIENT: The person whose name and contact details are declared at the payment step. (“CLIENT“)

3. Fees

3.1. The proposal form sent by the guide states the scope, date, duration, group size, total price (EUR) and the method of paying the remaining balance to the guide. The proposal form is an integral part of this agreement.

3.2. Platform Usage Fee: 15% of the total price is charged to the CLIENT once per reservation as consideration for the PLATFORM’s intermediary service described in Section 1. This fee is deducted from the total tour price; the amount payable to the guide is the total price minus this fee. At the payment step, the total price, the Platform Usage Fee and the remaining balance payable to the guide are each shown separately and clearly.

3.3. Remaining Balance (85%): The remaining 85% is the tour fee and is exclusively a matter between the CLIENT and the guide. It is paid directly to the guide, by the method and at the time stated in the guide’s proposal. The PLATFORM is not a party to that payment, does not collect it and assumes no obligation in respect of it.

3.4. No additional taxes, duties or costs are added to the Platform Usage Fee.

4. Payment

4.1. The Platform Usage Fee is collected in a single charge by credit/debit card via the secure infrastructure of iyzico Ödeme Hizmetleri A.Ş.

4.2. Card details are never seen, processed or stored by the PLATFORM.

5. Performance of the Service

5.1. Upon approval of the payment, the reservation becomes final; a confirmation message is delivered in the chat screen and a booking summary (voucher) is sent by e-mail.

5.2. The PLATFORM’s intermediary service is deemed immediately, fully performed and consumed upon delivery of the booking confirmation. By ticking the consent box at the payment step, the CLIENT expressly requests and consents to immediate performance of the service before the expiry of any withdrawal period.

5.3. The tour is performed by the relevant guide on the date, at the time and within the scope stated in the proposal form.

6. Non-Refundability; Sole Counterparty for Cancellations

6.2. Any request concerning cancellation, postponement, date or scope changes of the tour, or concerning the remaining 85% tour fee, must be addressed exclusively to the guide. The CLIENT accepts that no cancellation, modification, refund or compensation may be claimed from the PLATFORM in these matters.

6.3. In the event of a guide-initiated cancellation, the PLATFORM may, as a gesture of goodwill, assist the CLIENT in finding an alternative guide or date; this is not an obligation and does not give rise to any refund of the Platform Usage Fee.

6.4. Duplicate or erroneous charges are refunded to the original card via iyzico upon notification.

7. Right of Withdrawal

Pursuant to Articles 15/1-g and 15/1-h of the Turkish Regulation on Distance Contracts (services relating to leisure activities to be performed on a specific date, and services performed immediately with the consumer’s express consent before expiry of the withdrawal period), no right of withdrawal applies to this agreement.

8. Limitation of Liability; General Provisions

8.1. The relevant guide is solely responsible for the performance, non-performance, defective performance, cancellation or modification of the tour and for any damage arising during the tour. The PLATFORM’s total liability under this agreement shall in all cases be limited to the Platform Usage Fee collected for the relevant reservation.

8.2. The PLATFORM publishes the guides’ official licence details on their profiles; guides are independent professionals and are not employees, representatives or agents of the PLATFORM.

8.3. By completing the payment step, the CLIENT confirms having read and electronically accepted this agreement, the Pre-Information Form and the Platform Fee & Cancellation Policy. The consent record (date, time and transaction data) is stored by the PLATFORM and constitutes evidence in any dispute, including payment disputes and chargebacks.

8.4. The invalidity of any provision of this agreement shall not affect the validity of the remaining provisions.

9. Disputes

Disputes arising from this agreement are subject to the Turkish Consumer Arbitration Committees and Consumer Courts within the monetary limits announced annually by the Ministry of Trade. This agreement is governed by the laws of the Republic of Türkiye.

10. Entry into Force

This agreement is concluded upon the CLIENT’s electronic consent at the payment step and completion of the Platform Usage Fee payment.
